The user expressly agrees
that the use of this banner advertising network is at the users
sole risk.
NNH its representatives, advertisers and sponsors do not guarantee
that this service will not be interrupted or error free; nor do
we make any warranty as to the results that may be obtained from
the use of this service or as to the accuracy, reliability, AVAILABILITY
or content of any information, data, or service contained in or
provided through this service. This service may be modified from
time to time or even DELETED WITHOUT NOTICE.
NNH will not be liable for any loss or disclosure of personal
or business information or loss of network credits, earnings or
sales that occurs through the use of or deletion of this service.
Under no circumstances, including negligence, shall NNH its representatives,
advertisers, sponsors, or any one else involved in creating, producing
or distributing our services be liable for any direct, indirect,
incidental, special or consequential damages or losses that result
from the use of or inability to use the banner network; or that
results from mistakes, omissions, interruptions (downtime), DELETION
OF ACCOUNTS, errors, defects, delays in operation, or transmission
or any failure of performance, whether or not limited to acts
of God, communication failure, theft, destruction or unauthorised
access to our records, systems, programs or services.
Indemnification
You agree that you shall defend, indemnify, save and hold NNH harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors' fees, ("Liabilities") asserted against NNH, its representatives, advertisers or sponsors, that may arise or result from the use of this service. The user agrees to defend, indemnify and hold harmless NNH against Liabilities arising out of (i) any injury to person or property caused by any products sold or otherwise distributed in connection with this banner exchange network; (ii) any material supplied by the user infringing or allegedly infringing on the proprietary rights of a third party; (iii) copyright infringement and (iv) any defective product which the user sold on this banner network or on any banner network supplied to the user by NNH
NNH reserves the right to deny at its sole discretion any user access to this banner network or any portion thereof without notice. You are responsible for safeguarding the confidentiality of your password(s) and user name(s) issued to you by this banner network, and for any use or misuse of your account resulting from any third party using a password or user name issued to you.
NNH may terminate this
agreement at any time, and your access to any or all of this network
and the related services without penalty, if the user fails to
comply with the terms of this Agreement.
In addition, if you violate any of these Terms of Use, you will
forfeit all in-kind credits and amounts accuring to you (if any)
in connection with this banner exchange network.
IF YOU ARE DISSATISFIED
WITH ANY PART OF THIS BANNER NETWORK, OR WITH ANY OF THESE TERMS
OF USE, YOUR SOLE REMEDY IS TO DISCONTINUE USING THIS BANNER NETWORK
AND ITS RELATED SERVICES.
